Terms of Service

By accessing or using CyberShield ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Service Description

CyberShield provides AI-powered cybersecurity services including vulnerability scanning, breach monitoring, and security training for small businesses. The Service is provided as software-as-a-service (SaaS) on a subscription basis.

2. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

3. Subscription and Payment

• Subscriptions are billed monthly in advance
• A 14-day free trial is provided for new accounts
• Payments are processed by Stripe and subject to their terms
• You may cancel at any time; access continues until the end of the billing period
• No refunds are provided for partial months
• We reserve the right to change pricing with 30 days notice

4. Acceptable Use

You agree not to:

• Use the Service to scan systems you do not own or have authorization to scan
• Attempt to circumvent plan limits or access controls
• Resell, sublicense, or redistribute the Service
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service or its infrastructure

5. Vulnerability Scanning

You represent and warrant that you have authorization to scan any URL you submit to CyberShield. You are solely responsible for ensuring you have permission to scan target systems. CyberShield is not responsible for unauthorized scans conducted through the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices described therein.

7. Intellectual Property

CyberShield retains all rights to the Service, including all software, algorithms, and content. You retain ownership of your data. We do not claim ownership of scan results or company data you submit.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. CYBERSHIELD DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT SECURITY VULNERABILITIES WILL BE DETECTED. CYBERSECURITY IS AN EVOLVING FIELD AND NO TOOL IS 100% COMPREHENSIVE.

9. Limitation of Liability

IN NO EVENT SHALL CYBERSHIELD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account for violation of these terms without refund. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These terms are governed by the laws of the State of New York. Disputes shall be resolved through binding arbitration.
